Terms and Conditions

1. Purpose

These Terms and Conditions govern access to and use of the 1818tours.com website and its subdomains, as well as the booking and participation in tours organised by Valsa do Horizonte, Lda. (Tax ID: [NIF]) (trading as "1818 Tours"). By making a booking, the customer fully accepts these terms.

1818 Tours is a tourist entertainment agent registered in Portugal's RNAAT (National Register of Tourist Entertainment Agents) under no. 799/2026.

2. Bookings and payments

• Bookings are made through reservas.1818tours.com or directly with our team.
• Each tour has a maximum of 8 participants per group.
• A booking confirmation is sent by email after submission.
• Prices shown are per person and include transport, guide and any other services indicated in each tour's description, unless stated otherwise.
• All prices include VAT at the applicable rate.
• Payment methods: you may pay online at the time of booking (by card, via SumUp), or on site on the day of the experience (cash or card, on a SumUp reader). For online payments, the booking is only confirmed once payment has been successfully collected; while payment is pending, your seat is held for a limited period.

3. Discount codes

• We may issue discount codes through partners, affiliates or our own campaigns.
• The discount is applied at the time of booking. Codes entered after a booking is completed are not applied retroactively.
• Unless stated otherwise, codes cannot be combined with each other or with other promotions on the same booking.
• Each code may have an expiry date, a maximum number of uses, or be limited to certain tours. These conditions are stated alongside the code.
• We reserve the right to change or deactivate any code at any time. Bookings already completed with a valid code are not affected.
• Codes obtained through unauthorised means, resold, or used abusively may be refused, and the booking cancelled with a refund of any amount paid.
• The terms governing the relationship between 1818 Tours and its affiliates are set out in the Affiliate Programme Rules.

4. Cancellations and changes

• Customers may cancel or change their booking at any time by contacting us by email or phone.
• Cancellation more than 24 hours in advance: full refund.
• Cancellation less than 24 hours in advance: no refund, except in cases of force majeure duly evidenced (e.g. serious illness, family emergency).
• 1818 Tours reserves the right to cancel or reschedule a tour due to adverse weather conditions or safety reasons. In such cases, the customer will be notified as soon as possible and offered an alternative date or a full refund, at no additional cost.

5. Right of withdrawal

Pursuant to Article 16(l) of Directive 2011/83/EU (transposed into Portuguese law by Article 17(l) of Decree-Law No. 24/2014 of 14 February), contracts for leisure services providing for a specific date or period of performance are excluded from the 14-day right of withdrawal. By confirming a tour booking, the customer expressly acknowledges and accepts this exclusion.

6. Tour conditions

• Experiences take place outdoors, in natural areas of the Autonomous Region of Madeira, which may include mountainous terrain, and are therefore subject to variable weather conditions.
• Participants must wear clothing and footwear appropriate for the planned activity, including the possibility of uneven terrain and low temperatures.
• Participants are responsible for informing us in advance of any health, mobility or allergy conditions relevant to their safety during the tour.
• 1818 Tours reserves the right to refuse participation to anyone who, at the time of the tour, does not meet minimum safety requirements (e.g. inadequate footwear, health condition incompatible with the activity).

7. Liability

Participation in the tours involves accepting the risks inherent to outdoor and mountain activities. 1818 Tours acts with appropriate safety care and holds public liability insurance, but is not liable for damages resulting from a participant's failure to follow the guides' instructions or the requirements set out in these Terms.

8. Intellectual property

All content on the website (text, images, logo and design) is owned by 1818 Tours or duly licensed, and may not be reproduced without prior written authorisation.

9. Dispute resolution

These Terms and Conditions are governed by Portuguese law. In the event of a consumer dispute, the customer may refer the matter to the CACC — Centro de Arbitragem de Conflitos de Consumo da Madeira (Rua Direita, No. 27 – 1st Floor, 9050-450 Funchal; [email protected]; tel. +351 291 147 115), the certified ADR entity for the Autonomous Region of Madeira. For contracts concluded online, the European Online Dispute Resolution (ODR) platform is also available at ec.europa.eu/consumers/odr. For judicial resolution, the courts of Madeira shall have jurisdiction, without prejudice to any mandatory consumer jurisdiction.
